Terms & Conditions

1. Our contract

All bookings are made with Peru Machupicchu 2RS S.A (a company registered in Peru so you will be subject to Peruvian laws at all times). By booking a trip with us you are deemed to have agreed to the terms and booking conditions as listed below (which constitutes the entire agreement between you and us) and your booking will be accepted by us on this basis.

2. Customers Identification

All travel and identification documents required are your responsibility; requested information provided to Peru Machupicchu 2RS S.A by the customer must be an exact match to the passport that will be used during travel. You are responsible for all fees and expenses that may be incurred due to incorrect information or to the denial of travel due to incorrect information. A revision fee of $30 per person will be assessed by Peru Machupicchu 2RS S.A for requested information corrections or revisions.

In order for us to confirm your travel arrangements you must provides all requested details. Necessary details vary by trip; they include but are not limited to full name as per passport, date of birth, nationality, gender, passport number, passport issue and expiry date and any pre-existing medical conditions you have which may affect your ability to complete your travel arrangements. On some more demanding trips we also require you to complete and forward a self-assessment form. Failure to provide requested details may result in additional charges or non-refundable cancellation of your trip.

3. Passport and Visas

It is your responsibility to secure the proper documentation prior to joining the trip program.

You must carry a passport which is valid for 6 months beyond the date of travel. Before arrival, please verify current entry requirements and obtain the necessary travel documentation (visas, permits or certificates) based on the country of origin, destination and any countries in which a stop is scheduled.

Peru requires that children under 18 years of age must travel with the consent of both parents. Please verify the most current documentation and entry requirements with your country’s consulate or an immigration office. No refund will be issued for losses incurred as a result of failure to obtain or provide required valid documentation.

4. Booking and Payment

A deposit is required per person for your booking to be confirmed and will be advised of the amount at the time you request the booking, (this deposit is non-refundable in case of cancellation by the customer). This deposit must be received within 5 days of booking to secure a reservation. All balances are due to 45 days prior to departure. If your booking is made within 45 days prior to departure date then the full amount is payable at the time of booking.

Please note that special policies may apply and will be advised at time of reservation.

***LACK OF PAYMENT WILL RESULT IN AN AUTOMATIC CANCELLATION OF BOOKING.

If payment is not received by the due date, airline and all other reservations will be cancelled. In such a case, we will retain the deposit. Peru Machupicchu 2RS S.A is not responsible for any penalties, fare increases or fees incurred due to late payment.

5. Acceptance of booking and final payments

If we accept your booking we will issue a confirmation invoice. The services to be provided are those referred to in your booking confirmation invoice; a contract will exist between us from the date we issue the confirmation invoice. If you book within 7 days of departure the contract will exist when we accept your payment. Please refer to your booking confirmation invoice for details regarding final payments.

Payment of the balance of the trip price is due 45 days prior to departure.

6. Method of Payment

At the moment Peru Machupicchu 2RS S.A only accepts deposits through Western Union and Paypal.

7. Prices & Surcharges

Our trip prices are subject to variable and seasonal pricing, both of which are standard practice within the travel industry. This means our trip prices may vary at any time in accordance with demand, market conditions and availability. It is likely that different clients on the same trip have been charged different prices. If you like the price you see, your best option is to book at that time. Once you have received a quote the price will be locked in provided you pay the required deposit prior to the quote’s expiry. Any reduced pricing or discounts that may become available after you have paid your deposit will not apply. If you wish to cancel your booking to take advantage of a cheaper price, full cancellation conditions apply.

We reserve the right to impose surcharges up to 60 days prior to departure due to unfavorable changes in exchange rates, increases in airfares or other transportation costs, increases in local operator costs, taxes, or if government action should require us to do so. In such instances we will be responsible for any amount up to 2% of the trip price and you will be responsible for the balance. If any surcharge results in an increase of more than 10% of the trip price you may cancel the booking within 14 days of notification of the surcharge and obtain a full refund. We will not surcharge any booking for travel within the validity of this brochure once paid in full.

Please note that a surcharge may be applied to all purchases made by credit card.

Prices 2022: Prices per person depend on the group size, the larger the group is, the lower the price per person is. Please contact us specifying:

  • Number of participants / Departure date
  • Type of accommodation: Tourist class (3***hotel), First class (4**** hotel), Deluxe (5*****hotel)
  • Train service: Expedition (Tourist class), Vistadome (First Class) and Hiram Bingham (Luxury train)
  • Type of service: Shared tours or private tours.

***Available discounts (these discounts are not accumulative):

  • Students: US$ 12.00 (students require a valid International Student Identity Card “ISIC”. Please, note that Youth Travel Cards are not valid)
  • Teenagers: US$ 12.00 (up to 15 years of age, passport copy required for all bookings)

8. Cancellation by the traveller

Peru Machupicchu 2RS S.A will assess a fee for cancellations in case the customer cancels some or all portions of the trip program, this should be notified to Peru Machupicchu 2RS S.A as soon as possible; a cancellation will only be effective when we receive written confirmation of the cancellation.

You are strongly advised to take out cancellation insurance at the time of booking which will cover cancellation fees. If you leave a trip for any reason after it has started we are not obliged to make any refunds for unused services or partially used travel components for any reason. If you fail to join a tour, join it after departure, or leave it prior to its completion, no refund will be made. The above cancellation fees are in addition to fees which may be levied by accommodation providers, travel agents or third party tour and transport operator fees.

Cancellation fees for Custom Programs:

  • Up to 45 days prior to departure, we will retain the deposit;
  • 45 – 31 days prior to departure, we will retain 50% of the total booking cost
  • 30 – 16 days prior to departure, we will retain 75% of the total booking cost.
  • 15 – 1 days prior to departure, we will retain 100% paid by you in connection with the booking.

Cancellation fees for Hikes & Expeditions:

  • Up to 30 days prior to departure, we will retain the deposit;
  • 30 – 16 days prior to departure, we will retain 75% of the total booking cost.
  • 15 – 1 days prior to departure, we will retain 100% paid by you in connection with the booking.

***INCA TRAIL: Cancellations within 30 days of departure, the unused Inca Trail permits will be given as well as the return train ticket from Aguas Calientes to Cusco and the bus tickets from Machupicchu Inca Citadel to Aguas Calientes. Customers may be able to re-use the tickets by presenting them to the respective authorities and paying an additional amount, which varies depending on the ticket.

Documents will be issued on fully paid reservations approximately 30 days prior to departure.

We cannot give any allowance or refund for meals, rooms, excursions, etc. not taken, when these are included in the price of the tour. No refund can be made on lost, mislaid or destroyed travel tickets or vouchers. There will be no refunds made for cancelled or unused services.

Any reimbursement expenses derived from a cancellation by you, will not be assumed by Peru Machupicchu 2RS S.A.

***NO SHOWS:

Failure to travel without prior notification is considered a NO-SHOW and the entire cost of reservation is non-refundable.

9. Cancellation by us

Peru Machupicchu 2RS S.A reserves the right to cancel a trip in case any of the following circumstances occur:

Customer’s failure to pay the due balance of 45 days or at agreed date (according the booked program) prior to the departure date. In this case, the customer will not have any right for the deposit refund.

We may cancel a trip at any time prior to departure if, due to terrorism, natural disasters, political instability or other external events it is not viable for us to operate the planned itinerary. If we cancel your trip, you can transfer amounts paid to an alternate departure date or receive a full refund.

In circumstances where the cancellation is due to external events (Bad weather conditions, sickness, etc.) beyond our reasonable control refunds will be less any unrecoverable costs.

If any of the circumstances listed above occur during the course of the tour, we reserve the right to alter the scheduled trip itinerary accordingly and no compensation will be paid. We will make every reasonable effort to provide you with the booked program arrangements but changes may occur. If they are significant we shall, if possible, inform you before the departure date and the additional cost of the changes will be covered by the customer.

10. Booking Amendments

If you wish to transfer from one trip to another or transfer your booking to a third party you must notify us at least 60 days prior to the proposed departure date. A fee of 40.00 USD per person per change will apply (in addition to any charges levied by hotels, ground operators or airlines). If you notify us less than 60 days prior to the proposed departure date the refund policy applicable to cancellations will apply. Transfers to a third party are only permitted where the transferee meets all the requirements in relation to the trip, and transfers to another departure can only be made to a departure within the current validity period.

Amendments to any other arrangements made in conjunction with your trip will incur a 60.00 USD administration fee per booking per change. This fee is in addition to any charges levied by hotels, ground operators or airlines. Any change made will result in the reservation being re-priced at the rate in effect at the time of the change. A “name change” constitutes a cancellation and cancellation fees will apply. No amendments are permitted to your booking within 10 days of departure.

11. Inclusions

The land price of your trip includes:

  • All accommodation as listed in the Essential Trip Information
  • All transport listed in the Essential Trip Information
  • Sightseeing and meals as listed in the Essential Trip Information
  • The services of a tour guide as described in the Essential Trip Information

12. Exclusions

The land price of your trip does not include:

  • International or internal flights unless specified
  • Kitty as specified in the Essential Trip Information
  • Airport taxes and excess baggage charges unless specified
  • Meals other than those specified in the Essential Trip Information
  • Visa and Passport fees
  • Travel insurance
  • Optional activities and all personal expenses
  • Tip

13. Rates

All rates are quoted in U.S. Dollars unless otherwise noted. Rates are subject to change at any time, without notice. Peru Machupicchu 2RS S.A reserves the right to make adjustments if a particular rate was incorrectly stated. Government and supplier-imposed taxes and fees are subject to increase at any time.

14. Age & Health requirements

Minimum Age: For the majority of our trips the minimum age is 8 at the time of travel. All travellers under the age of 18 must be accompanied by a legal guardian, or in lieu of a legal guardian, by an escort over the age of 18, appointed by their legal guardian. The legal guardian or their designee will be responsible for the traveller under the age of 18’s day to day care. If a legal guardian elects to designate an escort in their lieu, they will be required to complete and sign a relevant document, to delegate their authority.

Please note we cannot guarantee triple or adjoining rooms for families.

Maximum Age: For the majority of our trips we have no upper age limit though we remind you that some of our trips can be physically demanding and customers must ensure that they are suitably fit to allow full participation.

It is vital that all medical problems are communicated to us prior to departure.

We are able to provide details on mandatory health requirements; however, we are not medical experts. It is your responsibility to ensure that you obtain proper and detailed medical advice at least two months prior to travel for the latest health requirements and recommendations for your destination.

Peru Machupicchu 2RS S.A reserves the right to exclude any participant from one of our tours in case this person is not physically / mentally prepared for the chosen program or if the service has not been paid fully before the trip start.

***PHYSICAL DISABILITIES:

Customers requiring special facilities, services or accommodations must disclose such needs to Peru Machupicchu 2RS S.A at time of reservation. Wheelchair-accessible transportation and accommodations may be requested, but cannot be guaranteed. Available accommodation standards vary by hotel and are not within the control of Peru Machupicchu 2RS S.A.. The facilities for disabled persons may be extremely limited in your foreign destination.

15. Small groups and guaranteed departures

Our trips are guaranteed to depart once they have one fully paid customer unless minimum group size specifically states otherwise.

16. Travel Insurance

Travel insurance is mandatory for all our customers and should be taken out at the time of booking. Your travel insurance must provide cover against personal accident, death, medical expenses and emergency repatriation. We also strongly recommend it covers cancellation, curtailment, personal liability and loss of luggage and personal effects. You must provide proof of your travel insurance on the first day of your trip; you will not be able to join the trip without it. Our trip cost does not include these types of insurances.

17. Flexibility

You appreciate and acknowledge that the nature of this type of travel requires considerable flexibility and you should allow for alternatives. The itinerary provided for each trip is representative of the types of activities contemplated, but it is understood that the route, schedules, itineraries, amenities and mode of transport may be subject to alteration without prior notice due to local circumstances or events.

18. Change of itinerary

While we endeavor to operate all trips as described, Peru Machupicchu 2RS S.A reserves the right to change the trip itinerary. Please refer to our website before departure for the most recent updates to your itinerary.

Before departure: If we make a major change we will inform you as soon as reasonably possible if there is time before departure. The definition of a major change is deemed to be a change affecting at least one day in five of the itinerary. When a major change is made you may choose between accepting the change, obtaining a refund of money paid on the land portion of the trip only or accepting an alternative tour offered.

After departure: We reserve the right to change an itinerary after departure due to local circumstances or events out of our control. In such emergency circumstances the additional cost of any necessary itinerary alterations will be covered by you. Please note we are not responsible for any incidental expenses that may be incurred as a result of the change of itinerary such as visas, vaccinations or non-refundable flights.

19. Authority on tour

Our trips are run by a tour guide. The decision of the tour guide is final on all matters likely to affect the safety or well-being of any customer, staff member participating on the trip or the group.

If you fail to comply with a decision made by a tour guide, or interfere with the well-being or mobility of the group, the tour guide may direct you to leave the trip immediately, with no right of refund.

We may also elect not to carry you on any future trips booked. You must at all times strictly comply with the laws, customs, foreign exchange and drug regulations of Peru, and you also agree to travel in accordance with our responsible travel guidelines.

20. Acceptance of risk

You acknowledge that the nature of the trip is adventurous and participation involves a degree of personal risk. You will be visiting places where the political, cultural and geographical attributes present dangers and physical challenges greater than those present in our daily lives. We use information from government foreign departments and reports from our own contacts in assessing whether the itinerary should operate. However it is also your own responsibility to acquaint yourself with all relevant travel information and the nature of your itinerary. You acknowledge that your decision to travel is made in light of consideration of this information and you accept that you are aware of the personal risks present upon such travel.

The customer excludes Peru Machupicchu 2RS S.A from any responsibility linked to any accident or injury that may occur associated to the customer’s health, physical condition or other.

21. Limitation of liability

Peru Machupicchu 2RS S.A. is only responsible for reserving the items listed in the reservation details. The services to be provided are those referred to in your booking confirmation invoice; by making a reservation with Peru Machupicchu 2RS S.A, the customer acknowledges that in all events Peru Machupicchu 2RS S.A shall not be liable for any incidental or consequential damages and that the sole extent of Peru Machupicchu 2RS S.A’s liability, if any, shall never exceed the amount actually paid by customer to Peru Machupicchu 2RS S.A.

These Terms and Conditions of Sale are subject to change at any time at Peru Machupicchu 2RS S.A’s sole discretion without notice.

A. We will accept liability for the negligence of our staff or agents causing death or physical injury to persons, loss or damage to personal property only to the extent it is obliged under the applicable law. Our obligations, and those of our suppliers providing any service or facility included in your holiday, are to take reasonable skill and care to arrange for the provision of such services and facilities. This acceptance of liability is subject to clause C. below.

B. In other circumstances we are responsible to you for the proper performance of this contract. This acceptance of liability is subject to clause C. below.

C. We shall not be liable for any damage or loss if the failure to carry out the contract is:

  • Attributable to you (loss or damage to property or injury to persons, caused by reason of any act or omission, intentional, negligence by the customer)
  • Attributable to a third party unconnected with the provision of the services contracted for and the event is unforeseeable or unavoidable.
  • Due to an event which the Company, even with all due care could not foresee or forestall.
  • Due to political disputes, border closures, refusal of visas, industrial action, climate or other matters of a similar nature and any other force majeure.
  • Due to unforeseen and unusual circumstances beyond our control, the consequences of which could not have been avoided even if all due care had to be exercised.

D. Except in cases involving death, injury or illness, any liability covered under clause B. above is limited to 2 times the price paid. In the case of damaged property the liability is limited to a maximum amount equal to the amount paid by or on behalf of the owner of the property. In all cases the Company specifically excludes all liability for indirect or consequential loss or expense including loss of profits and in all cases our liability will be limited in accordance with and/or in an identical manner to the contractual terms of the companies that provide the transportation for your travel arrangements.

E. Where your trip arrangements involve travel by air, rail, highway or sea, or hotel accommodation, the compensation is limited by the following international conventions respectively: Warsaw Convention as amended 1955, Bern Convention 1961, Athens Convention 1974 and Paris Convention 1962. We are to be regarded as having all benefit of any limitation of right to claim or compensation contained in these or any conventions.

The suppliers providing transportation and accommodations (“Suppliers”) for the vacations are independent contractors and are not agents, affiliates, representatives or employees of Peru Machupicchu 2RS S.A. We have no ownership interest in any Supplier. Any use of the Peru Machupicchu 2RS S.A name by a Supplier is just for identification purposes only and does not constitute ownership, agency, supervision or control by Peru Machupicchu 2RS S.A.

All documentation, receipts and tickets are issued subject to the terms and conditions specified by the Supplier. By utilizing the services of the Suppliers, you agree that Peru Machupicchu 2RS S.A not shall be liable for that.

***AIR / RAIL / HIGHWAY / SEA TRANSPORTATION

Peru Machupicchu 2RS S.A has no control over and assumes no liability for bus, train, boat, airline strikes, schedule changes, trip cancellations or others bus, train, boat and airline initiated changes. In the event of such an occurrence, the bus, boat, train and airline are responsible and will determine what action will be taken.

***ACCOMMODATIONS

Facilities, guest services and amenities are provided at the discretion of the hotel and are subject to change without notice. Any additional costs are the responsibility of the customer and are payable directly to the hotel. Room location, connecting rooms and bedding requests are not guaranteed and are based upon availability at time of check in. Hotel descriptions and photos do not necessarily depict the actual room in which guests will be accommodated; maps and images may not be exact or to scale, and are for general description purposes only. Room standards are the sole responsibility of the hotel. Hotel ratings are based on information provided by the hotel and Peru Machupicchu 2RS S.A’s own evaluations.

***PERSONAL PROPERTY AND BAGGAGE

Baggage checked or carried on board an aircraft or vehicle is subject to fees based on weight, number and size. All baggage fees are the responsibility of the customer and are payable directly to the Supplier. Please, contact the Supplier for their current baggage policy. Peru Machupicchu 2RS S.A is not responsible or liable for any delay, loss or damage to baggage and personal property.

We are not responsible for any incidental expenses that you may have incurred as a result of your booking including but not limited to visas, vaccinations, and travel insurance excess or non-refundable flights.

F. Our acceptance of liability in clauses A and B above is subject to assignment by you of your rights against any agent, supplier or sub-contractor which is in any way responsible for the unsatisfactory arrangements or your death or personal injury.

22. Optional activities

Optional activities not included in the trip price do not form part of the trip or this contract. You accept that any assistance given by your tour guide in arranging optional activities does not render us liable for them in any way. The contract for the provision of that activity will be between you and activity provider.

23. Claims & complaints

If you have any reason to complain, please inform your supplier, tour conductor, guide or our local representative while on the tour so that they can attempt to rectify the matters at the earliest opportunity. If satisfaction is not reached through these means, please email or telephone us as soon as possible.

Any further complaint should be sent by email or put in writing to us within 10 days of the end of the tour.

24. Photos and marketing

You consent to us using images of you taken during the trip for advertising and promotional purposes in any medium we choose. You grant us a perpetual, royalty-free, worldwide, irrevocable license to use such images for publicity and promotional purposes.

25. Privacy policy

Any personal information that we collect about you may be used for any purpose associated with the operation of a trip or to send you marketing material in relation to our events and special offers. The information may be disclosed to our agents, service providers or other suppliers to enable us to operate the trip. We will otherwise treat your details in accordance with our privacy policy (available for viewing on our Website).
